GameServerPimp (GSP) provides this
Acceptable Use Policy ("AUP") and Terms of Service
(“TOS”) to give our customers and their guests
a clear understanding of what GSP expects of them while
using the service. All individuals accessing GSP servers
must comply with these requirements, whether a client or
guest of a client.
USE OF GSP SERVERS REQUIRES ACCEPTANCE
OF THESE TERMS AND ACCEPTANCE IS IMPLIED VIA USE. LACK OF
KNOWLEDGE OF THESE TERMS DOES NOT CONSTITUTE AN EXCUSE FOR
BREACH.
General Terms
- ALL PAYMENTS TO GSP ARE NON-REFUNDABLE.
- GSP DOES NOT PROVIDE TECHNICAL SUPPORT
VIA THE TELEPHONE
- ALL REQUESTS FOR TECHNICALL SUPPORT
MUST BE INITIATED AND MONITORED THOUGH THE WEBSITE
- THE CUSTOMER IS RESPONSIBLE FOR HAVING
MET THE LICENSING REQUIREMENTS (HAVE A “KEY”)
FOR ANY GAME SERVER SOFTWARE PREINSTALLED BY GSP AT CUSTOMERS
REQUEST. GSP PROVIDES THE INSTALLATED FILES AS A COURTESY
ONLY AND DOES NOT SELL, RENT, OR LOAN GAME SERVER SOFTWARE.
- FAILURE TO ABIDE BY THE TERMS OF THIS
AUP AND TOS MAY RESULT IN DISCONNECTION OF THE SERVER
WITHOUT PRIOR NOTICE
Payment
- PAYMENT FOR SERVERS IS DUE BY THE
ANNIVERSARY OF THE SERVER ACTIVATION DATE. Any server
that has not been paid by such date is subject to disconnection
without notice.
- GSP will invoice the customer via email
approximately five days in advance of the invoice due
date.
- GSP accepts payment by credit card,
money order, check, and PayPal. A Credit Card Authorization
form must be completed for credit card payment. PayPal
payments are accepted only from VERIFIED accounts. Personal
checks will be held until they clear. PayPal check payments
will be processed immediately, however they are subject
to immediate disconnection in the event the funds do not
clear. Money orders and bank checks will be honored as
cash.
- All payments to GSP are non-refundable.
Cancellation
- The customer may cancel service by
emailing GSP support.
- After canceling service, the customer
will continue to receive service until the remaining portion
of service already paid for has been delivered.
- All payments to GSP are non-refundable,
as such service cancellation will not entitle the customer
to a refund of any already paid funds.
- Cancellation requests must be made
at least 10 days in advance of service renewal date
Technical Support
- GSP DOES NOT PROVIDE TECHNICAL SUPPORT
VIA THE TELEPHONE. Those who call the sales telephone
requesting support will be redirected to the website without
exception.
- GSP provides limited technical support
for the games. We will work to ensure the operation of
the game with a stock configuration. Any modification
or trouble shooting beyond the stock configuration is
the responsibility of the customer.
- GSP provides support for the hardware
and operating system of our servers, except in the case
where the customer has requested administrative level
access to the operating system, in which case GSP provides
support for the hardware only.
- All technical support inquiries MUST
be initiated through the web site trouble ticket system.
Requests for support via email may not be answered in
a timely manner.
- Reboot requests are completed during
business hours only. GSP does not guarantee a turn around
time for reboot requests, however a best effort will be
made to reboot a machine in a timely manner. Those requiring
immediate reboot service are advised to purchase the Remote
Reboot Option.
- The customer is expected to have the
basic level of knowledge and experience required to operate
a game server. GSP cannot provide remedial teaching support.
- Servers which are rendered inoperable
by action of the customer will be subject to a $30 reinstallation
fee. A reinstallation will delete any existing data on
the system.
Software
- GSP provides the server operating
system and one or more open source utilities (VNC, FTP,
ect..) as needed.
- GSP may pre-install one or more games,
however the customer is responsible for meeting any licensing
requirements for game server software and utilities (i.e.
having a legitimate “software key”). Failure
of the customer to do so may subject the customer to legal
liability with respect to the software property owner.
This applies whether the software was installed by the
customer or by GSP at customer’s request.
- The customer is responsible for meeting
licensing requirements for any software he/she installs
himself/herself, with or without the knowledge of GSP.
Service Credits
- Service credits will be for one day
of service, or a credit of one day for each day service
was affected, which ever is greater.
- Service credits will ONLY be issued
if: a) a network disruption ON THE GSP NETWORK occurred
and it substantially affected the customer’s service
for a period greater than one hour, or b) the server was
unavailable for use through no fault of the customer.
Unavailability of service caused by a failure of the customer
to follow GSP provided directions does not quality for
service credits.
- Service credits will not be issued
for downtime caused by a delay in executing a server reboot
request, unless the delay exceeds more than 1 BUSINESS
day, as measured from the time the trouble ticket was
opened.
- Should GSP elect to provide service
credits even if not so obligated herein, it shall not
set precident for future issueance of service credits
to the customer.
Network Performance
- GSP expends a large amount of effort
to ensure the best possible network performance across
the Internet. GSP monitors key traffic exchange points
across the Internet to develop reliable data upon which
performance is measured.
- The Internet is not controlled by
any single entity and GSP has direct control ONLY over
it’s own network, thus GSP CANNOT make any guarantee
whatsoever as to the consistency of network performance.
However, GSP will make a best effort at all times to ensure
consistently high performance.
- In the event GSP detects a network
performance issue it will make every effort to reroute
traffic if possible, and/or to resolve the issue as quickly
as possible.
- GSP measures network performance using
the commonly accepted “ping” command included
with every modern TCP/IP aware computer operating system
(Windows, UNIX variants, and Mac OS 10). In Windows the
command can be accessed via a DOS command prompt. In OS
10 and UNIX the command is available on the command line.
The “ping” command is a reliable and accurate
tool for measuring network latency, and is the ONLY tool
GSP will recognize for network diagnostics.
- GSP DOES NOT RECOGNIZE “IN GAME”
PING OR OTHER PERFORMANCE INDICATORS TAKEN FROM WITHIN
GAME SOFTWARE. Such measurements are unreliable and are
not standardized. In addition they are greatly affected
by CPU utilization of the server and the customer’s
computer, and therefore are NOT direct or reliable measurements
of network performance.
Acceptable Use
- GSP servers are to be used only for
their intended purpose (running game servers).
- GSP servers may be used only for lawful
activity.
- Customer must follow all written guidelines
provided by GSP for correct operation.
- You may not run a public file server
or web server.
- You may not exceed the total player
limit you pay for, or run a Battlefield2 Ranked game server
when paying for Battlefield2 Unranked
